1. Agreement to Terms

By accessing or using the services provided by LHE Digital LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

LHE Digital LLC provides web design, digital marketing, lead generation, AI-powered automation, and related services for local service businesses. Specific deliverables and pricing are outlined in individual service agreements.

3. Client Responsibilities

Clients are responsible for providing accurate business information, timely feedback, and any content or assets required for project completion. Delays caused by client non-responsiveness may affect project timelines.

4. Payment Terms

Setup fees are due prior to project commencement. Monthly subscription fees are billed on a recurring basis. All fees are non-refundable unless otherwise stated in a written service agreement. Late payments may result in service suspension.

5. Cancellation

Monthly services may be cancelled at any time with 30 days' written notice. There are no long-term contracts unless explicitly agreed upon. Upon cancellation, access to managed services will cease at the end of the current billing period.

6. Intellectual Property

Upon full payment, clients own the website design and content created specifically for their project. LHE Digital LLC retains the right to showcase completed work in our portfolio. Third-party tools, plugins, and platform subscriptions remain subject to their respective terms.

7. SMS/Text Messaging Terms

LHE Digital LLC offers an SMS messaging program for service-related communications including appointment confirmations, service updates, follow-up messages, and responses to your inquiries. You must be 18 years of age or older to opt in to this SMS service.

By providing your phone number and checking the consent box on our contact form, you agree to receive recurring automated text messages and/or phone calls from LHE Digital LLC at the mobile number you provided. Message frequency varies. Message and data rates may apply.

Consent to receive text messages is not required as a condition of purchasing any goods or services.

To opt out: You can cancel the SMS service at any time. Just text "STOP" to the phone number from which you received the message. After you send STOP, we will send you a confirmation message, and you will no longer receive SMS messages from us. If you want to rejoin, you can sign up again through our contact form. You may also opt out by emailing info@lhedigital.com, calling us, or communicating your request through any reasonable means.

Supported carriers include but are not limited to: AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, and other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

We will not share your mobile information with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Message and data rates may apply for any messages sent to you from us and to us from you. By opting in, you acknowledge and agree to these SMS Terms of Service and our Privacy Policy.

8. Indemnification

You agree to indemnify, defend, and hold harmless LHE Digital LLC, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of our services; (b) your breach of these terms; (c) content you provide to us for use in your website or marketing materials; or (d) your violation of any applicable law or regulation.

9. Limitation of Liability

LHE Digital LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability shall not exceed the amount paid by the client in the preceding 12 months. Services are provided "as is" without warranties of any kind, express or implied.

10. Disclaimer of Results

We do not guarantee specific results such as search engine rankings, lead volume, or revenue increases. Results vary based on industry, location, competition, and other factors outside our control. Any examples of results or performance referenced on our website are illustrative and do not represent a guarantee of similar outcomes.

11. Dispute Resolution

Any dispute arising from these terms or our services shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration in the State of Texas, in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs of arbitration. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Governing Law

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

13. Changes to Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
